The Registration Act, 1908, the Transfer of Property Act, 1882 and the Real Estate (Regulation and Development) Act, 2016 mandates the registration of an agreement for sale of an immovable property. By registering the agreement for sale of an immovable property, it becomes a permanent public record. Further, a person is considered as the legal owner of an immovable property only after he gets such property registered in his name.

To sell a house, you typically need the original deed, a seller net sheet, mortgage payoff statement, homeowners insurance records, and any necessary disclosures such as lead-based paint information if applicable. Additionally, keeping records of major home improvements can be beneficial for pricing and transparency with buyers

To qualify for exemptions on capital gains tax, you typically need to meet specific criteria related to the type of asset sold and your income level. For example, long-term capital gains may be exempt from federal taxes if your taxable income falls below certain thresholds, such as $48,350 for single filers in 2025.

Whether you need to pay stamp duty on a property transferred as a gift depends on the laws of the specific jurisdiction where the property is located. Generally, many regions impose stamp duty on property transfers, including gifts, typically calculated based on the property’s market value.  Despite any applicable exemptions, you may still need to complete and submit relevant documentation to the tax authorities.

To buy a house, you typically need proof of income (like pay stubs and tax returns), proof of employment, bank statements, and information about any debts you have. Additionally, lenders may require other documents depending on your financial situation and the type of loan you are applying for.
